Driver’s License Suspension after a DUI
In some cases, those convicted of DUI in California will have their driver’s licenses suspended, either by the court or the Department of Motor Vehicles (DMV). However, contrary to popular opinion, this is not automatic and it is possible to fight a driver’s license suspension.
Following a first-time arrest for DUI, you have 10 days to request a hearing with the DMV for a temporary hold on administrative driver’s license suspension. This 10-day period begins immediately upon your arrest. If you fail to request this hearing within the 10-day time frame, the DMV may proceed with driver’s license suspension. It is important to note that the DMV can only conduct an administrative driver’s license suspension if your blood alcohol concentration (BAC) was 0.08% or higher.
If you are convicted of DUI in court, the judge does not suspend your license, but the court will notify the DMV of your conviction. The DMV can then impose the suspension of your license. By working with an attorney to have your charges reduced, you may be able to avoid a court-ordered driver’s license suspension.
Additionally, even if your driver’s license is suspended, you may be allowed to continue to drive under certain circumstances, most commonly if you agree to have an ignition interlock device installed on your vehicle. You may also be able to secure a restricted license, which allows you to drive to certain places—such as work or school—while your license is suspended.
